What to do when you find it

  1. Avoid disturbing it

Do not scrub or bleach large areas. Small spots on a tub or tile can be cleaned, but leave larger growth for the landlord to assess.

  2. Stop the water if you can safely

Close a supply valve under a leaking sink or toilet, and move belongings away from wet areas.

  3. Photograph everything

Take dated photos of the growth, any water source, and damaged belongings.

  4. Notify in writing

Send an email or letter describing what you found, where, and when. Keep a copy. Many leases name how notice should be given.

  5. Allow access

Cooperate with reasonable entry for inspection and repair, and note the dates people come.

Colorado's rules, in general terms

Colorado's residential habitability law was strengthened in recent years, and it addresses mold associated with dampness as a condition that can make a home unfit. The law describes how a tenant gives notice and how a landlord is expected to respond. Details, including timelines and remedies, are in the statute and can change, so read the current text or contact a tenant resource before relying on any particular right.

If you rent in a property governed by an HOA, the landlord is still your point of contact. If the source is a shared element, the landlord and the association may need to coordinate, but that is not a reason for your notice to go unanswered.

Withholding rent or moving out on your own can carry legal risk. Get advice from a tenant legal aid organization or attorney before taking those steps.
